TERMS AND CONDITIONS

Welcome to Zambian ARTS Publishing House. By accessing our website, submitting manuscripts, signing agreements, purchasing services, or engaging with any of our publishing operations, you agree to be bound by these Terms and Conditions.
1. Scope of Application
These Terms and Conditions govern all interactions, transactions, services, agreements, forms, submissions, consultations, publishing projects, printing services, and related activities conducted with Zambian ARTS Publishing House unless otherwise stated in a separate written agreement.
2. Project Engagement
Submission of a manuscript, completion of a form, signing of an agreement, payment for services, or engagement of any publishing package constitutes acceptance of these Terms and Conditions.
3. Project Cancellations
All project cancellations must be communicated officially through:
The designated cancellation or contact form on our website; or
Our official company email addresses.
Verbal notifications, social media messages, or communications through unofficial channels shall not constitute valid cancellation notices.
Any work completed before cancellation may remain chargeable.
4. Publisher Changes and Transfers
Authors intending to change publishers, transfer publishing rights, or move a project to another publishing service provider must communicate such intentions in writing before implementation.
Failure to provide prior notification may result in delays, administrative charges, or limitations regarding project transfer documentation.
5. Refund Policy
All refund requests must be submitted through:
The official complaints page on our website; or
An official company email address.
Refund requests shall be reviewed and assessed on a case by case basis to determine eligibility.
Where approved, refunds shall be processed within twenty eight (28) working days from the date of approval.
Refunds shall not apply to services already rendered, completed design work, completed editorial work, printing costs already incurred, third party service fees, or any non refundable expenses paid on behalf of the author.
6. Design Changes
Authors must communicate any requested design modifications, including cover design, interior formatting, branding elements, and related artwork, at least seven (7) days before the commencement of printing.
Design changes requested after printing has commenced may attract additional charges and may not be accommodated.
7. Account Management
Unless expressly agreed in writing before project commencement, Zambian ARTS Publishing House shall not be responsible for:
Managing Amazon accounts;
Managing author websites;
Managing social media accounts;
Updating third party publishing dashboards;
Ongoing technical maintenance services.
Any such services shall require a separate written agreement.
8. Market Performance Disclaimer
Zambian ARTS Publishing House does not guarantee sales, rankings, readership levels, market penetration, royalties, awards, reviews, or commercial success.
The company shall not be held liable for the performance or lack of performance of any project in physical, digital, audiobook, or other publishing formats.
9. Author Warranties
The author warrants that:
They are the rightful owner of the submitted work or possess the necessary rights and permissions.
The submitted content does not infringe any copyright, trademark, privacy, or intellectual property rights.
The content is not defamatory, unlawful, or otherwise prohibited by applicable law.
The author agrees to indemnify and hold harmless Zambian ARTS Publishing House against claims arising from violations of these warranties.
10. Intellectual Property Rights
Copyright ownership shall remain with the author unless otherwise specified in a separate written agreement.
The author grants Zambian ARTS Publishing House the necessary rights to edit, format, print, distribute, market, and publish the work as required under the selected publishing package.
11. Printing and Production
While every effort is made to maintain production quality, minor variations in color, paper texture, print positioning, and binding may occur due to printing processes and shall not constitute defects.
Authors are responsible for reviewing and approving final proofs before printing.
12. Author Approval
Final approval provided by the author for printing or publication shall constitute acceptance of the project’s content, design, formatting, and presentation.
The publisher shall not be liable for errors discovered after author approval.
13. Delivery Timelines
Estimated timelines provided for editing, design, publication, printing, distribution, or marketing activities are projections only and may be affected by operational, technical, supplier, or regulatory circumstances.
The company shall not be liable for delays beyond its reasonable control.
14. Limitation of Liability
To the fullest extent permitted by law, Zambian ARTS Publishing House shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of its services.
The company’s maximum liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.
15. Amendments
Zambian ARTS Publishing House reserves the right to modify these Terms and Conditions at any time. Updated versions shall be published on the official website and shall become effective upon publication.
16. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Zambia.
Any disputes arising under these Terms and Conditions shall be subject to the jurisdiction of the courts of Zambia.
